Terms of Service

1. Introduction and acceptance

These Terms of Service ("Terms") govern your access to and use of Swapoon (the "Service"), operated by Swapoon. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. What Swapoon is

Swapoon is a non-custodial interface for swapping one cryptocurrency for another. We do not operate the underlying exchange infrastructure ourselves: swaps are executed through third-party liquidity providers, which we may use from time to time. Swapoon provides the interface, routing, and order tracking; the movement and conversion of funds are performed by these providers.

We never take custody of your funds beyond the technical routing of a swap. You transact directly from your own wallet to a deposit address, and the swapped assets are sent directly to the receiving address you specify. No account creation is required, meaning no email, phone number, or personal data is collected at sign-up.

3. Eligibility and restricted persons

By using the Service, you represent and warrant that:

(a) you are at least 18 years of age;

(b) your use of the Service complies with all laws and regulations applicable to you, including tax obligations; and

(c) all information you provide (if any) is accurate and complete.

4. Compliance & Screening (No KYC / No AML)

Swapoon performs no KYC or AML screening on users. While third-party liquidity providers may run automated checks on incoming deposits, Swapoon itself does not collect, store, or verify user identity data. Deposits originating from high-risk addresses are automatically refunded according to the provider's policy; Swapoon does not freeze assets and does not require proof of identity for standard swaps.

You acknowledge that a swap may be automatically refunded, blocked, or reversed by a liquidity provider as a result of these checks, and that Swapoon does not control and is not responsible for those provider-side decisions.

5. Prohibited use

You agree not to use the Service in connection with any of the following, consistent with the standards applied by our liquidity providers: transactions involving Restricted Persons; weapons; controlled substances (unless duly licensed); unlicensed gambling; money laundering or terrorist financing; Ponzi, pyramid, or multi-level marketing schemes; goods or services that infringe intellectual property rights; unlicensed money transmission; counterfeit goods or fake identification; market manipulation, wash trading, front-running, or insider trading; and the purchase of goods from darknet markets or marketplaces facilitating illegal trade.

We reserve the right to decline to provide the Service, or to refer or route a transaction in accordance with a provider's policies, where we reasonably believe it relates to prohibited activity.

6. No Custody; your responsibility for addresses

You are solely responsible for the accuracy of the receiving address and network you provide. Blockchain transactions are irreversible. We cannot recover funds sent to an incorrect, incompatible, or wrong-network address, although, where a deposit is made on an unexpected network, our providers may allow a refund upon your submission of a valid refund address (see Section 8).

7. Quotes, rates, and fees

Rates displayed are estimates provided in real time by our liquidity providers and are only finalized when an order is created. Market movement between quotation and deposit confirmation may cause the amount actually received to differ from the quote. Network (miner) fees are inherent to blockchains and are reflected in the amount you receive.

Where an integrator or affiliate fee applies, it is disclosed as part of the swap and deducted from the deposited amount.

8. Refunds and wrong-chain deposits

If a deposit arrives late, in a different amount than expected, or on an unexpected network, your order may enter a review or refund state. Depending on the case, you may be able to continue the swap at the current market rate or request a refund to an address you provide. Refunds are processed by the liquidity provider and are subject to network fees.

9. Logging & Privacy (No Persistent Logs)

Swapoon operates on a "no logs" basis for user data. IP addresses, timestamps, and swap metadata are stored temporarily in memory solely for routing and provider compatibility purposes. All logged data is automatically deleted within 24 hours of swap completion (or immediately upon refund). Swapoon does not maintain persistent databases linking swaps to specific users or wallets beyond this period.

Third-party liquidity providers may log transactions on their side, but Swapoon does not retain provider-side logs. No cookies or tracking pixels are used for analytics unless explicitly consented to via our optional newsletter.

10. Risk disclosure

Cryptocurrency involves significant risk, including extreme price volatility and the possibility of total loss. Transactions may fail due to technical issues, smart-contract behaviour, network congestion, or third-party infrastructure outside our control. You use the Service at your own risk and are responsible for understanding the assets and networks you transact with.

11. No warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by law, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Limitation of liability

To the maximum extent permitted by applicable law, Swapoon and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, funds, or data, arising from or related to your use of the Service, including losses caused by third-party providers, network failures, compliance-driven refunds or blocks, user error, or the ephemeral nature of our logging system.

13. Indemnification

You agree to indemnify and hold harmless Swapoon and its operators from any claim or demand arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

14. Suspension and changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time. We may also decline to make the Service available in certain jurisdictions or to certain users, in our discretion or as required by law.

15. Changes to these Terms

We may update these Terms from time to time. The "last updated" date reflects the latest revision. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
